Biase Against Father's Parental Rights

Due to what is known as the Tender Year’s Doctrine, an outdated legal custom mandated custody of children under age seven be automatically awarded to mother as a default, assuming the mother was not unfit. This left fathers customarily disadvantaged in family law matters. For these reasons, fathers are likely to pay more in child support or be on the receiving end of an unfair custody order.

The fairness of the Tender Years Doctrine has been a subject of debate and criticism, leading to significant changes in many jurisdictions.

Here are some key points to consider:
  • Gender bias: Critics argue that the Tender Years Doctrine perpetuates gender stereotypes by presuming that mothers are inherently better caregivers than fathers. This presumption disregards the abilities and rights of fathers and reinforces traditional gender roles, which can be seen as unfair.
  • Individual circumstances: The doctrine focuses on the age of the child rather than the specific needs and circumstances of each family. It assumes that a child’s best interests are always served by being placed with the mother, disregarding other factors such as the parents’ ability to provide a safe and nurturing environment.
  • Equal parenting: Advocates for shared parenting argue that both parents should have equal rights and responsibilities in raising their children, regardless of gender. They contend that a child benefits from having ongoing and meaningful relationships with both parents, as long as they are capable and willing to provide adequate care.
  • Evolving societal norms: Over time, societal attitudes have shifted, recognizing the importance of gender equality and challenging traditional gender roles. Many jurisdictions have moved away from the Tender Years Doctrine and adopted a more gender-neutral approach, considering the best interests of the child as the primary factor in custody decisions.
  • Individual case assessment: Family courts now tend to evaluate custody cases on a case-by-case basis, taking into account the unique circumstances of each family and considering factors such as the child’s age, the parents’ caregiving abilities, the child’s relationship with each parent, and the child’s overall well-being.

Breaking Down Social Norms

Ultimately, opinions on the fairness of the Tender Years Doctrine vary, and it is essential to consider the evolving legal landscape in different jurisdictions. Many jurisdictions have recognized the need to move away from presumptions based on gender and instead focus on the best interests of the child, promoting shared parenting and individual assessments of custody cases.

These facts, while true, are unfortunate because the role of father’s in a child’s life is just as instrumental as the nurture and love from a mother. Although courts should not favor one parent over the other based on gender, this still happens. Your ability to secure representation that overstands the vital position male role models provide, will make all the difference.

This type of representation requires delicacy and sensitivity, which are qualities embodied in our Firm’s core values. We have successfully represented men in their pursuit to give their children the very best life possible.

Research has found children with involved fathers have stronger cognitive and motor skills, elevated physical and mental health, become better problem solvers and are more confident, curious, and empathetic. Fathers deserve to be represented just as zealous as mothers and we provide the same assurance to fathers that we care about their role in their child’s life.
