An uncontested divorce is the ideal method to part ways with your spouse, but the catch is both spouses must agree on all issues related to their divorce. This is not the likely scenario because by this point in the parties’ journey together, the fibers of the relationship have usually deteriorated past the ability to agree on much, especially not critical issues resulting from the demise of the marriage. There are obvious and various benefits uncontested divorces have over contested ones, since it is a simpler legal process. There will also likely be far less cost associated with lawyers’ fees, court fees, and quicker resolution.
This type of divorce can only happen when both parties can fully and completely agree on how to dispose of all the assets and debts they accumulated during the marriage.
Process for Uncontested Divorce
In Texas, an uncontested divorce is a relatively straightforward process. The first step in initiating an uncontested divorce is for one spouse, referred to as the petitioner, to file a petition for divorce with the appropriate district court in the county where they reside. This petition outlines the grounds for divorce and includes details regarding child custody, visitation rights, division of assets and debts, spousal support, if applicable, and any other relevant issues.
Once the petition is filed, the petitioner serves the other spouse, known as the respondent, with a copy of the petition and a citation, which notifies them of the divorce proceedings. The respondent then has a specified period to file a response, either agreeing or contesting the terms outlined in the petition. If the respondent agrees with all the terms, they can simply sign a waiver of service, acknowledging receipt of the petition, and submit it to the court.
After the response period has passed, or if the respondent files an answer in agreement, the next step is for both parties to work together to draft a final divorce decree, which is a legal document that details the agreed-upon terms of the divorce. This document covers various aspects such as property division, child custody and support, visitation schedules, and spousal support, if applicable. Both spouses review the final divorce decree carefully and ensure they are in agreement with its contents.
The Final Agreed Decree
Once the final divorce decree is completed and signed by both parties, it is submitted to the court for review and approval. A judge then examines the document to ensure it complies with the state’s laws and is fair and reasonable for both spouses and any children involved. If the judge approves the decree, they will issue a final divorce decree, effectively dissolving the marriage. Additionally, the specific requirements and procedures for an uncontested divorce in Texas may vary slightly depending on the county and local court rules.
Clients frequently ask when is the soonest they can be divorced following filing the petition. The Texas Family Code states the parties must wait a period of 60 days before any order of divorce can be entered. It is possible to achieve a divorce in 60 or so days, but only if the parties are both 100% committed to this and work efficiently within that period of time. It is impossible for a contested divorce to be completed in this time frame.
