Family law where the water meets the estate

Lakeway divorces rarely look like Austin divorces. The estate is heavier on property: the lake house, the dock, sometimes a short-term rental income stream, and lighter on simple accounts. Cases file in Travis County. The difference is not the courthouse. It is the valuation work before anyone signs.

Valuing a lake house properly

Waterfront property is Lakeway’s biggest asset and its hardest to divide. Two houses on the same street can differ by a wide margin because one has usable frontage and the other does not. A general residential appraisal will miss that entirely.

So the valuation has to account for what makes lake property lake property. Frontage, the dock and its permits, water access at different lake levels, and any short-term rental income the house produces. We bring in appraisers who work on Lake Travis, so the house is valued right before anyone trades it away.

Getting it wrong is not a small error. If the lake house is over-valued, the spouse who keeps it buys out an amount that was never there. If it is under-valued, the other spouse signs away real money. Neither is fixable once the decree is final.

Separate property, and proving it

Lakeway estates often include property owned before the marriage, or received by gift or inheritance. That is separate property, and it is not divided. Texas presumes everything is community, so the burden sits on whoever claims otherwise.

Proof means tracing: closing documents, statements and dates that follow the asset from before the marriage to today. Where community money paid down a separate-property mortgage or funded improvements, the community can claim reimbursement. Those claims are won on paperwork, not on argument, so we ask for the documents early.

Custody across the Lake Travis school district

Texas starts from the Standard Possession Order, and where the possessory parent lives within 50 miles of the child’s home the court must order the expanded version of it, with the longer Thursday and weekend periods, unless that parent declines it in writing or the court finds it is not in the child’s best interest. Lakeway, Bee Cave and The Hills all sit well inside that distance. An agreed schedule built around the actual school week, the commute over 620 and who can do pick-up on which days is also approved routinely when it is written properly.

Why a high-asset Lakeway case still belongs in mediation

Larger estates often settle better in mediation, not worse. The numbers are complex enough that neither side wants a judge deciding them in an afternoon, and once the lake house has been valued properly the argument usually narrows to one or two points. Travis County courts expect mediation before a contested final anyway; doing it early, before two sets of hourly bills start, is where the saving is.

Practical notes on the Travis County courthouse

Lakeway cases are filed with the Travis County District Clerk and heard in the family courts in downtown Austin, about forty minutes east on 71 or 2222. Travis County runs its own standing order that takes effect the moment a divorce or custody case is filed, and it differs from the Williamson County version used across the county line. It applies to you from day one.

Most Lakeway clients never make the drive. Agreed finals and uncontested orders are handled by submission or a brief Zoom prove-up. Contested hearings are a different matter: under the Travis County local rules in force since November 2024, hearings and trials are in person by default, and a remote setting needs either the agreement of all parties with the proceeding announced as remote, or a judge’s finding of good cause. Where is my Lakeway divorce heard?

In downtown Austin. Lakeway sits in Travis County, so the case is filed with the Travis County District Clerk rather than in Georgetown. Most of the work still happens over Zoom.

How is the lake house valued?

By an appraiser who works on Lake Travis. Frontage, dock permits, water access and any rental income all move the number, and a general residential appraisal usually misses them.

What if I owned the house before we married?

Can we keep the children in Lake Travis ISD after the divorce?

Usually, and it is often the one thing both parents agree on. Where both of you stay in the district, a possession schedule built around the school calendar is very achievable and courts approve agreed plans that put the children’s routine first.

Does rental income from the lake house count for child support?
