Family law on the north shore

Lago Vista sits on a peninsula above the north shore of Lake Travis, in Travis County. That means your case is filed with the Travis County District Clerk and heard in the family courts in downtown Austin, the same as an Austin case. What is different is everything around the courthouse: the property, the school district, and the drive.

One road in, and what that changes

RM 1431 is the main artery into Lago Vista. Most of what a family case demands, the filings, the negotiation, the mediation session itself, does not need you on that road at all, and we build the work that way from the first conversation.

Where the road does matter is in a parenting plan. A possession schedule written by someone who has not thought about the drive tends to fail in practice: a 6pm Thursday exchange means one parent leaving work early every week. A schedule built around the real commute holds up, and courts approve agreed plans that are workable far more readily than ones that look tidy on paper.

Lake and hill country property

Estates here lean toward property rather than simple accounts: waterfront or water-access lots, hill country acreage, sometimes a second property or short-term rental income. Two lots on the same street can be worth very different amounts depending on frontage, access and what can actually be built.

A general residential appraisal usually misses that, so the valuation has to be done by someone who works on Lake Travis. Getting it wrong is not a small error. If the property is over-valued the spouse who keeps it buys out money that was never there, and if it is under-valued the other spouse signs away real value. Neither is fixable once the decree is final.

Separate property, and proving it

Lots and homes here are often bought before a marriage, or come by gift or inheritance. That makes them separate property, and separate property is not divided. But Texas presumes everything is community, so the burden sits on whoever says otherwise.

Proof means tracing: closing documents, statements and dates that follow the asset from before the marriage to today. Where community money paid down a mortgage or funded improvements, the community can claim reimbursement. Those claims are won on paperwork rather than argument, which is why we ask for documents early.

Custody and Lago Vista ISD

Lago Vista has its own school district rather than sitting inside Lake Travis ISD, and it is small. Keeping children in the same schools is usually the one thing both parents agree on, and it makes an agreed possession schedule much easier to build.

Texas starts from the Standard Possession Order. Where the possessory parent lives within 50 miles of the child’s home, the court must order the expanded version, with the longer Thursday and weekend periods, unless that parent declines it in writing or the court finds it is not in the child’s best interest. If one parent moves toward Cedar Park or Austin, that 50-mile line is worth checking early, because it changes the default schedule.

Why mediation suits cases here

Two things make mediation practical for Lago Vista families. The first is distance: a virtual session removes the drive entirely, for both of you, on a day that would otherwise be lost. The second is the property. Once the valuation is done properly the disagreement usually narrows to one or two points, which is exactly what a session is for.

Travis County expects mediation before a contested final in any event. Doing it early, before two sets of hourly bills start, is where the saving is. Travis County runs its own standing order, which takes effect the moment a divorce or custody case is filed and differs from the Williamson County version used across the county line. It applies to you from day one.

Most clients never make the drive. Agreed finals and uncontested orders are handled by submission or a short Zoom prove-up. Contested hearings are different: under the Travis County local rules in force since November 2024, hearings and trials are in person by default, and a remote setting needs either the agreement of all parties with the proceeding announced as remote, or a judge’s finding of good cause.
